Derivatives Department of Yuanta Securities (Thailand) Company Limited (the “Company”, “We”, “Us”, “Our” or “Team DW19”) recognize the importance of your privacy. We have always placed importance on the security and protection of your personal data (as "you" or "your" or "Member”) through using our products and services.
This privacy notice (the "Privacy Policy") applies to the Personal Data (defined below in section 1) of (1) our individual customers/members including prospective customers (potential customers), current customers, and former customers/ members, and (2) Another person who contacts us through any channel or we are a service provider; and (3) Visitors and users of our website, applications, and social networking sites on mobile devices.
This Privacy Policy describes how we collect, use, disclose, and cross-border transfer (together as “Process”) your Personal Data including erasure or destroy your Personal Data, and your rights in accordance with the Thailand’s Personal Data Protection Act B.E. 2562 (“PDPA”). We may collect your Personal Data directly from you e.g. through our staffs, call center or other service channels or indirectly from other sources e.g. public sources, social media where you have set as public, outsourcing service providers, advisors, business partners, or any person having a contractual relationship with us. The types of Personal Data we collect depend on the relationship between the Clients or juristic persons and us, as well as services or products the Clients require from us.
“Sensitive Data" means Personal Data classified by law as sensitive data.
1.1 Identity Data: such as full name, gender, age, occupation, job title, business type, date of birth, information on government-issued cards (e.g., national identification number, passport number, tax identification number, driver's license details or similar identifiers), signature, education, household income, salary and personal income, investment records, detail of investment accounts and any other personal details you provided to us;
1.2 Contact details: such as postal address, delivery details, billing address, telephone number, fax number, email address, ID from social networking sites (e.g. LINE, Facebook, Google, Twitter), your contact person's contact details (e.g. telephone number, contact data on any correspondence), and any other contact details you provided to us;
1.3 Membership details: such as account details, member card number, reward points, member ID (e.g. DWVIP membership ID, member ID of DWVIP website, customer ID of Yuanta Securities (Thailand) and of other securities companies), member type, customer type, member join/registration date and month, membership period, account settlement details, service and product applications (e.g. membership application), and any other membership details;
1.4 Transaction details: such as details of transaction records about securities investment, payment to and from you, payment date and/or time, payment amount, details about refund, refund amount, points deposit, redeem convert and transfer, time and from which companies of transaction, transaction/order number, complaints and claims, transaction status, transaction type and any other details of products and services you have used;
1.5 Technical details: such as login log, access time and location, time spent on the page, login data, search history, browsing details, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on devices you use to access the platform, and any other technical details from the use on the platforms and systems;
1.6 Profile details: such as your username and password, transactions and historical trading recorders, your interests, preferences, feedback and survey responses, satisfaction survey, social media engagement, participation details, your use of points, attendance to Team DW19’s event and any other profile details;
1.7 Usage details: such as information on how you browse or use our websites, platform, application products and services and timestamp of last click and Q&A record, and any other usage details;
In case you deny giving the necessary information to us for providing our services, we may not provide you our services in part or in full. In case you give us the Personal Data of other person, you are responsible for notifying such person to acknowledge our Privacy Policy or our services’ Terms & Conditions, including having their consent prior disclose other person’s Personal Data to us in some case.
We do not knowingly collect information from customers under the age of 20 without their parental consent when it is required, or from quasi-incompetent persons and incompetent persons without their legal guardian's consent. We may disclose or transfer your Personal Data to the following third parties who process Personal Data in accordance with the purposes under this Privacy Policy. 3.1 Companies in the Yuanta Financial Holdings: As Team DW19 is part of Yuanta Securities (Thailand) Company Limited, and other companies within Yuanta Financial Holdings.
3.2 Our service providers: We may use other companies, agents or contractors to perform services on our behalf or to assist with the provision of products and services to you. We may share your Personal Data to these service providers, including but not limited to: (1) infrastructure, internet, infrastructure technical, software, website developer and IT service providers; (2) payment, payment system and authentication service providers and agents; (3) marketing, advertising media, and communications agencies; (4) call center; (5) campaign and event organizers; (6) telecommunications and communication service providers; (7) verifying and data checking service providers; (8) data storage and cloud service providers; and/or (9) dispatchers. In the course of providing these services, the service providers may have access to your Personal Data. However, we will only provide our service providers with the Personal Data that is necessary for them to perform the services, and we ask them not to use your Personal Data for any other purposes.
3.3 Our business partners: We may transfer your Personal Data to persons acting on your behalf or otherwise involved in the provision of the type of product or service you receive from us, including businesses of banking, finance, credit, loan, asset management, investment, insurance, credit cards, telecommunications, marketing, retail, e-commerce, reward and loyalty program, and data analytics, including platform sellers or providers whom we may jointly offer products or services, or whose products or services may be offered to you, to whom we disclose Personal Data in the course of providing products and services to you and whom you authorize us to disclose your Personal Data to, provided that these data recipients agree to treat your Personal Data in a manner consistent with this Privacy Policy.
3.4 Social networking sites: such as log on our sites and platforms using the social network login system, you explicitly authorize us to access and store public data on your social network accounts (e.g. Facebook, Google, Instagram), as well as other data mentioned during use of such a social network login system. In addition, we may also communicate your email address to social networks in order to identify whether you are already a user of the concerned social network and in order to post personalized, relevant adverts on your social network account if appropriate.
3.5 Third parties required by law: In certain circumstances, we may be required to disclose or share your Personal Data in order to comply with a legal or regulatory obligations. 3.6 Professional advisors: This includes technicians, auditors and lawyers, who assist in running our business, and defending or bringing any legal claims.
3.7 Third parties: such as assignees, transferees, or novates which we may assign, transfer, or novate our rights or obligations to a third party, to the extent permitted under the terms and conditions of any contract between you and us. We may disclose or transfer your Personal data to any assignees, transferees, or novatees, including prospective assignees, transferees, or novatees, provided that these data recipients agree to treat your Personal data in compliance of the Personal Data protection laws and in a manner consistent with this Privacy Policy;

(the “Company”) has created the DWVIP Platform and http://dwvip.co, including websites, websites for mobile devices or mobile Platform (“Platform”), to be the channel of contact and communication between the Company and its service users who are members of DWVIP ("Members"), including provision of services for the Members, such as applying for membership, checking remaining points and points that will expire, updating a Member's personal data, checking the Company's and/or its business partners' promotional campaigns and redeeming DWVIP‘s accumulated points according to the items specified by the Company and transferring the accumulated points between members and/or business allies, including other purposes to be later determined by the Company.
The Platform users ("User", "Users", "you" or "your") have read and accept that the Users will be bound by the Terms & Conditions specified in the Platform. Users are requested to study the following Terms & Conditions thoroughly and carefully before doing any transaction on the Platform. If you do any transaction on the Platform, it must be deemed that you accept and agree to comply with these Terms & Conditions. If you do not wish to be bound by these Terms & Conditions, please stop doing any transactions on the Platform. The Company has the right to correct, change or cancel these Terms & Conditions and/or any other agreements on the Platform without prior notice to Users.
1. The scope of Platform usage and general conditions
1.1 The Company reserves the right only for Members who have registered as Platform members to check remaining points and points that will expire, to update a Member's personal data, to check the Company's and/or its business partners' promotional campaigns, to redeem W points according to the items promoted in the Platform and to transfer the accumulated points between other members and/or business allies and for other purposes to be later determined by the Company.
1.2 The User represents that all the data provided to the Company on the Platform are true and complete. Specifically, the User also represents that his/her mobile number or personal email is valid at the time of providing the data.
1.3 The User agrees and acknowledges that the Company does not warrant the accuracy and completeness of content on the Platform and does not warrant that the Platform is virus-free or free from other things that may affect your mobile device.
1.4 Before conducting any act via the Platform, the User must check his/her name and family name, Member number and the remaining accumulated points that appear in the Platform and in the e-mail sent to you to the e-mail address or other personal data used for communication specified by you after doing any transaction via the Platform every time.
1.5 The User must check the conditions for rights and privileges, including participation in the activities on the Platform before receiving the rights and privileges and being able to participate in the activities via the Platform.
1.6 Each time the Platform is used, it is deemed that the User knows of these Terms & Conditions, including any amendments thereof which are fully effective at that time, and agrees to comply with those Terms & Conditions and any amendments thereof in all respects.
1.7 The User acknowledges that any collection, use, disclosure, and/or cross-border transfer of your personal data will be in accordance with the Privacy Policy

Platforms, websites or applications of such third parties shall not be deemed a part of the Company’s platform and not be under control or responsibility of the Company when the User links to such platforms, websites or applications. When the User leaves the Platform of the Company and continues to proceed at the User’s own risk. The Company do not guarantee the accuracy and credibility of the information specified on third parties’ websites and the Company hereby denies all responsibility against loss or damage suffered by the User arising from referring to messages which exist or not exist on the Platform, websites or application of the third parties. Showing of advertisement is not considered expression of approval or recommendation from the Company.
1.10 If there is a reasonable cause, the Company may suspend or cancel the provision of service, including changing the list of trade promotions via the Platform without any announcement or prior notice.
1.11 The accumulated points that appear when checking points will be the accumulated points up to the latest patch that the Company finish calculating for Users, except in cases Users provide a new form of data that the Company require more time to identify and calculate points and business allies which submit the points to the Company later, the points will be calculated and shown on the platform once the Company can correctly process data provided by Users and under the conditions of the Company or specified by its business allies.
1.12 The accumulated points redeemed via the Platform will be processed and will be deducted from the remaining points immediately.
1.13 In redeeming the points on the Platform, the User will not receive any email, summarizing the redemption of points of points. However, the User may check the points redemption history in the <Point Record> menu.
1.14 When the User confirms the redemption of points on the Platform, the points cannot be refunded.
1.15 The redeemed accumulated points will be deducted in the on the basis of "First in, First out”.
1.16 Accumulated points will be valid for 2 (two) years from the year when User gets the points. The Company will calculate the accumulated points on the last day of every calendar year by checking name, surname, member number and accumulated points appeared on the Platform every time before exchanging the points on the Platform.
2. Applying for being a Member
2.1 The service applicant may apply to be a Member by providing the Company with the data specified by the Company, including obtaining approval for being a Member from the Company. The service user will be bound by, and must comply with the terms and conditions for membership of DWVIP.
2.2 The applicant accepts and agrees to be bound by the terms and conditions of the membership’s agreement specified by the Company valid at the time of registering with this Platform via all means, including those terms and conditions as amended from time to time.
2.3 The applicant represents that all the data provided to the Company for registration for being a Member are true and complete. Specifically, the applicant also represents that his/her mobile number or personal email is valid at the time of providing the data.
2.4 The applicant for DWVIP member must not be a minor and must not be under the age of 20. The applicant for DWVIP member must not be an incompetent person or a quasi-incompetent person.
2.5 The Company reserves the right to cancel the membership or modify the conditions for rights and privileges without prior notice.
3 Registering for using the Platform
3.1 The service applicant can register to use the Platform by providing the Company with the data as specified by the Company, including an approval for being a Member from the Company. The service user will be bound by, and must comply with these Terms & Conditions. The service applicant will set the Member passwords and authenticate himself/herself by using the OTP sent by the Company within a specified period of time. The Member must keep the passwords confidential and must not disclose them or do anything that may enable others to know the passwords.
3.2 The Member represents that all the data provided to the Company for registration as a Member on the Platform are true and complete. Specifically, the applicant also represents that his/her mobile number or personal email is valid at the time of providing the data.
4 Updating the Member's personal data
4.1 A Member can update his/her personal data via the Platform.
4.2 The Member undertakes that in case of any changes made on his/her personal data, the Member will keep his/her personal data up-to-date at all times.
